Terms of Service

These terms govern your use of Digital Worker Exchange (“DWX”), operated by George Kamouzis in Illinois, United States. By creating an account or using the site you agree to them. Questions: support@digitalworkerexchange.com.
1. What DWX is — and what it is not
DWX is a marketplace where independent creators can present AI-powered digital workers and businesses can discover them and submit a deployment request. DWX does not build, operate, host or supervise the digital workers listed on the marketplace.
DWX is not an employer, employment agency, staffing firm, agent, broker, fiduciary, reseller or guarantor of any creator or digital worker. Any engagement you enter into with a creator is between you and that creator.
Sample data. Listings, creator identities, ratings, review counts, review content, testimonials and verification labels currently shown on DWX are sample or demonstration data unless clearly identified otherwise. They are illustrative and must not be relied on as claims about real products, real customers or real performance.
Verification. Where a listing shows a sample verification label, no DWX review has taken place. If DWX offers real verification in future, it would mean DWX reviewed capability accuracy, security disclosure, creator identity and support readiness. It would never be a guarantee of performance, security, legality or regulatory compliance.
2. Deployment requests
Submitting a Request Deployment form creates a scoping and contact request. It is not an order, purchase, licence, subscription or booking, it does not take payment, and it creates no payment obligation for you and no obligation for DWX or a creator to provide anything. DWX currently processes no payments and offers no escrow, refunds or marketplace purchase protection.
3. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. If you register on behalf of an organisation, you confirm you are authorised to do so. You are responsible for the accuracy of your account details, for keeping your credentials confidential, and for activity that occurs under your account, including access you grant to external AI agents or clients. Tell us promptly if you believe your account has been compromised.
4. Acceptable use
You agree not to:
- Use DWX for any unlawful, deceptive, infringing or harmful purpose.
- Post false, misleading or manipulated listings, reviews, ratings or capability claims.
- Impersonate another person, business or creator, or misstate an affiliation.
- Attempt to access accounts, data or systems you are not authorised to access, or circumvent security or access controls.
- Scrape, overload, disrupt or reverse engineer the service beyond what applicable law permits.
- Upload malware or submit content you do not have the right to submit.
5. Creator and listing responsibilities
If you submit a digital worker for listing, you are solely responsible for it. You confirm that the role, capabilities, integrations, permissions, security statements and pricing you declare are accurate and not misleading, that you hold the rights and licences needed for the worker and any third-party services or models it uses, and that you will keep the listing current. Security and permission statements shown on a profile are creator-declared; DWX does not independently certify them.
A submission is a request for listing. DWX may accept, reject, edit for clarity, delay or remove any listing at its discretion, and does not promise placement, distribution, traffic, leads or revenue.
6. Your responsibility to evaluate
You are responsible for evaluating whether any digital worker is suitable for your needs — including its legality in your jurisdiction and industry, the permissions and data access it requires, its security posture, the accuracy and appropriateness of its outputs, and its fit with your own obligations to customers and regulators. Outputs of AI systems can be inaccurate or incomplete; do not rely on them without human review.
7. Intellectual property
DWX and its name, wordmark, site design and content are owned by the operator or its licensors. Content you submit remains yours; by submitting listing content, reviews or other material intended for display, you grant DWX a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce and distribute it for the purpose of operating and promoting the marketplace. You may not use DWX branding in a way that implies endorsement, partnership or verification you do not have.
8. Feedback
If you send us suggestions or feedback about DWX, you grant us an unrestricted, royalty-free right to use it without obligation or compensation to you.
9. Third-party services
DWX links to and relies on third-party services, including hosting, database and authentication providers and any external sites or demos a creator links to. Those services are governed by their own terms, and DWX is not responsible for them or for their availability, security or content.
10. Suspension and termination
You may stop using DWX and ask us to close your account at any time. We may suspend or terminate access, remove content, or discontinue features at any time, including where we believe these terms have been breached or where required to protect the service or other users. Sections that by their nature should survive termination will survive it.
11. Disclaimers
DWX is provided “as is” and “as available” without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy. We do not warrant that the service will be uninterrupted or error-free, that listing information is accurate or current, or that any digital worker will achieve any particular result. Nothing on DWX is legal, tax, security or compliance advice.
12. Limitation of liability
To the maximum extent permitted by applicable law, DWX and its operator will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill or business opportunity, arising from or related to your use of DWX or any dealing with a creator. To the maximum extent permitted by law, our total aggregate liability for all claims relating to DWX will not exceed one hundred United States dollars (USD 100), since the service is currently provided without charge. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless DWX and its operator from claims, damages, losses and reasonable expenses arising from your use of the service, your content or listings, your dealings with another user or creator, or your breach of these terms or of applicable law.
14. Changes to these terms
We may update these terms as DWX develops. We will change the effective date above when we do. Continuing to use DWX after an update means you accept the revised terms.
15. Governing law and venue
These terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws rules. You and DWX agree that the state and federal courts located in Illinois will have exclusive jurisdiction over any dispute arising from these terms or your use of the service.
16. Severability and entire agreement
If any provision of these terms is held unenforceable, the remaining provisions stay in force and the unenforceable provision will be applied to the maximum extent permitted. Our failure to enforce a provision is not a waiver of it. These terms, together with our Privacy Policy, are the entire agreement between you and DWX regarding the service.
